1) Agreement to Terms

Welcome to MyAutoSound (“we”, “us”, “our”). By accessing or using our website, progressive web app, and related features (collectively, the “Service”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2) Service Description

MyAutoSound provides information and tools to help users describe and better understand vehicle noises and potential causes. Results are generated from user inputs, uploaded or recorded audio, and automated systems, including AI-generated outputs, and are provided for general information only.

The Service may include both free and paid features. Some features may require credits or payment before access is granted, including but not limited to full diagnostics, audio-based analysis, downloadable reports, premium recommendations, or similar advanced features.

3) Paid Features, Credits & Unlocks

Some parts of the Service are available only through paid access. We may offer credits, packs, one-time unlocks, or other paid mechanisms to access premium features.

• Unless otherwise stated, 1 credit unlocks 1 full diagnostic.
• A credit is considered used once the paid feature or full diagnostic has been unlocked or consumed by the Service.
• Credits are non-transferable, non-exchangeable, and have no cash value.
• Unused credits remain tied to the account used to purchase or receive them.
• We may change available packages, feature access, pricing, or credit structure at any time, subject to applicable law.

4) Payments, Billing & No-Refund Policy

If you purchase credits or paid features, you agree to provide accurate payment information and authorize the applicable payment processor to charge the stated amount.

Unless otherwise required by applicable law, all purchases are final and non-refundable. This includes purchased credits, used credits, partially used packs, unlocked diagnostics, and digital features that have already been delivered or made accessible.

Purchasing a paid feature or consuming a credit gives you access to that feature only. It does not guarantee that the output will be accurate, complete, suitable, repair-saving, or free of error.

5) No Professional Advice

The Service does not provide professional automotive advice, diagnostics, or repair services. Content and outputs are for informational purposes only and may be incomplete, inaccurate, or unsuitable for your specific vehicle. Always consult a qualified mechanic for inspection and repair.

6) AI-Generated Outputs

The Service may use artificial intelligence, automated classification systems, and other software models to generate outputs. These outputs are probabilistic and may be incorrect, incomplete, outdated, misleading, or unsuitable for your vehicle or situation.

You acknowledge that:

• AI-generated content is not guaranteed to be accurate.
• Different inputs, recordings, or conditions may produce different results.
• A paid result is still an informational output only and is not a guaranteed diagnosis.

7) Safe Use

• Do not use the Service while driving or in any situation requiring your full attention.
• Repairs and inspections involve risk. Do not attempt any procedure unless you are qualified and have proper tools, PPE, and safety equipment.
• Always follow your vehicle manufacturer’s official procedures and specifications.

8) User Responsibilities

You are responsible for the accuracy of the information you provide, including descriptions, selected symptoms, uploaded audio, and recordings. You are also responsible for any actions you take based on the Service. You are responsible for complying with applicable laws and safety rules.

9) Accounts & Eligibility

If you create an account or use account-based features, you must provide accurate information and keep your credentials secure. You must be at least the age of majority in your jurisdiction to use the Service or purchase paid features.

You are responsible for all activity under your account.

10) Acceptable Use

You agree not to misuse the Service, including: reverse engineering, scraping at scale, introducing malware, infringing intellectual-property rights, attempting unauthorized access, abusing promotions or credits, submitting fraudulent claims, or using the Service to harass or harm others.

11) Abuse, Fraud & Account Restrictions

We reserve the right to suspend, restrict, cancel, or terminate access to the Service or any account if we reasonably believe there has been abuse, fraud, attempted chargeback abuse, manipulation of credits, fake submissions, duplicate exploitation, or any misuse of the Service.

Where permitted by law, we may cancel credits or deny access to paid features obtained through abuse, fraud, or payment reversal.

12) User Submissions & Uploaded Audio

If you upload or submit recordings, audio files, descriptions, or other content to the Service, you represent that you have the right to submit that content and that doing so does not violate any law or third-party rights.

You retain ownership of your content, but you grant us a non-exclusive, worldwide, royalty-free license to host, process, analyze, store, and use it as needed to operate, improve, secure, and support the Service, subject to our Privacy Policy and any consent terms you are shown at submission.

13) Third-Party Services

The Service links to or relies on third-party services and resources (for example payment processors, maps, hosting providers, Google Maps/Places, OpenStreetMap, tutorials, and vendors). We do not control and are not responsible for third-party content, availability, pricing, downtime, decisions, or outcomes.

14) Intellectual Property

All trademarks, logos, code, models, text, graphics, site design, reports, and other materials in the Service are our property or licensed to us. You may not reproduce, distribute, sell, republish, or create derivative works without permission, except as allowed by law.

15) Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, merchantability, accuracy, performance, or availability. We do not warrant that outputs will be correct, complete, safe, uninterrupted, or suitable for your specific vehicle.

16) Limitation of Liability

To the maximum extent permitted by law, MyAutoSound, its owners, developers, affiliates, contractors, and partners are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; or for lost profits, data, goodwill, business interruption, missed repairs, wrong repairs, towing costs, diagnostic costs, vehicle downtime, personal injury, property damage, or vehicle damage arising from or related to your use of (or inability to use) the Service, including any repair attempts or reliance on any output.

17) Indemnity

You agree to indemnify and hold MyAutoSound harmless from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your submissions, your misuse of paid features or credits, or your violation of these Terms.

18) Modifications

We may update these Terms at any time. The “Last updated” date will change. Your continued use of the Service after changes become effective constitutes acceptance of those changes.

19) Governing Law & Venue

These Terms are governed by the laws of Québec and Canada, without regard to conflict-of-laws principles. Courts located in Montréal, Québec, will have exclusive jurisdiction, subject to any non-waivable local consumer rights.
